The People of the State of New York, Respondent, v. Jarrett Smith, Defendant-Appellant.


Defendant having moved, pro se, for leave to prosecute as a poor person an appeal taken from a judgment of the Supreme Court, New York County, rendered on or about April 1, 2001, and for assignment of counsel and related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied as moot, a decision and order from this Court having been entered on March 18, 2003, unanimously affirming the aforesaid judgment of the Supreme Court, New York County, rendered on or about April 1, 2001.
