Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Monroe County Court, rendered April 9, 2015,

Now, upon reading and filing the statement of Cordell Smith dated September 23, 2016 and the affidavit of Cordell Smith sworn to June 10, 2015, the notice of motion with proof of service thereof, the statement of Daniel Gross, Esq. dated October 27, 2016, the affirmation of Brian J. Shulman, Esq. dated July 23, 2014 [sic], and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as untimely.
