THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. PARIS SMITH, DEFENDANT-APPELLANT.


PRESENT: , P.J., SMITH, FAHEY, CARNI, AND SCONIERS, JJ.

Appellant having moved for an extension of time to file and serve a pro se supplemental brief on the appeals taken from the judgments of the Oneida County Court, rendered March 17, 2010,

Now upon reading and filing the affidavit of Paris Smith sworn to February 23, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that defendant provides to the Clerk's Office proof of service of said briefs upon assigned counsel by April 8, 2012, and upon such receipt of proof of service, the Clerk is directed to accept the brief for filing, and

It is further ORDERED that respondent shall file a brief in response to the pro se supplemental brief, if any, on or before April 30, 2012.
