On order of the Court, the application for leave to appeal from the July 9, 2002 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court.

Cavanagh, J. would remand to the Wayne Circuit Court for an evidentiary hearing regarding the defendant's claim that he was denied effective assistance of counsel.
