Concur: HISCOCK, CHASE, CUDDEBACK, HOGAN, CARDOZO and POUND, JJ.; WILLARD BARTLETT, Ch. J., concurs solely on the authority of People v. Lammerts ( 164 N.Y. 137). Were it not for that decision he should deem the indictment fatally defective.
