The purported indictment and its alleged certification by the County Clerk of Broome County upon which appellant relies to vitiate his conviction, a copy of which was attached to his brief but not included in the record, is crucial on this appeal and his failure to produce it for the purposes of reargument is decisive. On reargument order of Special Term affirmed, without costs. Bergan, P.J., Coon, Gibson, Herlihy and Taylor, JJ., concur.
