On order of the Court, the delayed application for leave to appeal from the February 5, 1999 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would remand this case to the Wayne Circuit Court for further findings on whether the court was convinced beyond a reasonable doubt that defendant had the necessary intent with regard to the count of assault with intent to murder victim Terri Thompson.

Markman, J., not participating.
