DECISION & ORDER ON MOTION

Motion by appellant pro se, in effect, to vacate the dismissal of an appeal from a judgment of conviction of the City Court of Yonkers, Westchester County, rendered March 9, 2016, and for the assignment of counsel. Separate motion by Lawrence R. Sykes, Esq., counsel who represented appellant in the City Court, for the same relief.

Upon the papers file in support of the motions and no papers having been filed in opposition thereto, it is

ORDERED, on the court's own motion, that the motion by appellant pro se and the motion by Lawrence R. Sykes, Esq., are consolidated for purposes of disposition; and it is further,

ORDERED that the motions are denied.

It is noted that the notice of appeal was untimely (see CPL 460.10) and no extension of time to serve and file a notice of appeal has been granted.
