THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. WILLIE SINGLETON, DEFENDANT-APPELLANT.


PRESENT:

Defendant having moved pursuant to CPLR 5513(a) for an extension of time to take an appeal from an order of the Ontario County Court, dated May 25, 2006 and entered June 8, 2006,

Now, upon reading and filing the affidavit of Willie Singleton sworn to May 26, 2015, the notice of motion with proof of service thereof, the affidavit of R. Michael Tantillo sworn to June 26, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary.

Memorandum: There is no indication in the motion papers that either party served the order with written notice of entry, and, therefore, the time to take the appeal has not yet begun to run (see CPLR 5513[a]).
