By order of December 28, 1999, the delayed application for leave to appeal was held in abeyance pending the decision in People v Sabin (Docket No. 114953). On order of the Court, the decision having been issued on July 27, 2000, 463 Mich. 43 (2000), the application is again considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for reconsideration in light ofPeople v Sabin, supra.
