Solano County Super. Ct. No. FCR248922; FCR277179.
RIVERA, J.
Jennifer M. Simmons appeals from judgments in two cases upon her pleas of no contest to misdemeanor animal neglect (Pen. Code, § 597, subd. (b)). Her counsel raises no issues and asks this court for an independent review of the record to determine whether there are any arguable issues. (People v. Wende (1979) 25 Cal.3d 436.) Defendant was apprised of her right to file a supplemental brief but did not do so.
On June 28, 2010, defendant pleaded no contest to one count of misdemeanor animal neglect in case number FCR248922. This case resulted from defendant’s failure to adequately feed Crystal, an Arabian horse, who was found to be extremely underweight and was living at defendant’s residence in a pen where the water trough was filthy and appeared to be stagnant. On the same day, defendant also pleaded no contest to two additional counts of misdemeanor animal neglect in case number FCR277179. That case arose from defendant’s failure to provide hay and water for two ponies who were found to be thin due to lack of food and to have sand in their feces.
On December 20, 2010, the court suspended imposition of sentence and placed defendant on probation for three years on conditions including that she serve sixty days in the county jail in each case; the sentences to run consecutively for a total of 120 days in the county jail.
Defendant was represented by counsel. There was no error in the sentencing. This court has reviewed the entire record and there are no meritorious issues to be argued.
The judgments are affirmed.
