Opinion

Motion No. 2020-04057

02-09-2021

The People of the State of New York, Respondent, v. Brandi Simmons, Defendant-Appellant.

Present - Hon. Sallie Manzanet-Daniels, Justice Presiding, Barbara R. Kapnick Peter H. Moulton Tanya R. Kennedy Saliann Scarpulla, Justices. Ind. No. 662/15
Case No. 2020-01163

An appeal having been taken to this Court from a judgment of the Supreme Court, Bronx County, rendered on or about December 11, 2019,

And defendant-appellant having moved, pro se, for leave to file a pro se supplemental brief on the aforesaid appeal, and for an extension of time in which to file a writ of habeas corpus,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that that branch of the motion seeking leave to file a pro se supplemental brief is denied as premature, the appeal not as yet having been perfected; that branch of the motion seeking an extension of time in which to file a writ of habeas corpus is denied inasmuch as this Court is not a proper forum for such application, as defendant is presently incarcerated in Clinton County, New York (see CPLR 7002 [1-4]).
