THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. EDWARD SIMCOE, DEFENDANT-APPELLANT.


PRESENT:

Counsel for appellant having moved for permission to withdraw as assigned counsel on an appeal taken from a judgment of the Onondaga County Court, rendered October 9, 2012, on the ground that the appellant has abandoned the appeal,

Now, upon reading and filing the affirmation of Kristen N. McDermott, Esq. dated May 17, 2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that Susan R. Horn, Esq. is relieved of her assignment, and

It is further ORDERED that the appellant perfect the appeal on or before August 31, 2017, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
