Sides, 75 N.Y.2d 822, 824; People v. Welch, 307 A.D.2d 776, 777, lv denied 100 N.Y.2d 625; People v. Youngblood, 294 A.D.2d 954, 955, lv denied 98 N.Y.2d 704; People v. Burgos, 291 A.D.2d 904, lv denied 97 N.Y.2d 751).
