CRIMINAL PROCEDURE, § 14information, sufficiency of verification. An affidavit stating that the within information and the matters and facts therein stated are true in substance and in fact was sufficient and the words "in substance and in fact" did not affect the positive averment that the facts stated against the defendant were true.

Error to County Court of Whiteside county; Hon. HARRY J. LUDENS, presiding.

Judgment affirmed. Heard in this court at October term, 1941.
