People of Michigan v. Jon Donald Siesling

LC No. 03-4560-FC.

Jane E. Markey, Presiding Judge, Mark T. Boonstra, Christopher P. Yates, Judges.

ORDER

The motion for immediate consideration is GRANTED. The motion to hold remand for evidentiary hearing in abeyance is DENIED.

This Court is unpersuaded by defendant's arguments that we should address the validity of his juvenile lifer sentence under People v Taylor, __ Mich. __; __ N.W.2d __ (2022) (Docket No. 154994), before the Ginther hearing. See People v Siesling, unpublished order of the Court of Appeals, entered September 14, 2022 (Docket No. 359354). That prior order remains in effect. Defendant may raise his claim under Taylor in his appeal as of right following the Ginther hearing. This Court retains jurisdiction.
