Appellate Division of the Supreme Court of New York, Second Department
May 24, 1943
266 App. Div. 801 (N.Y. App. Div. 1943)

Opinion

May 24, 1943.

Judgment of the Court of Special Sessions of the City of New York, Borough of Brooklyn [County of Kings], convicting the defendant of a violation of section 484 of the Penal Law (permitting children to attend certain resorts), reversed on the law, the information dismissed, and the fine remitted. The evidence failed to establish a violation of section 484 of the Penal Law. There is no proof that the defendant admitted children to the moving picture theatre, or allowed them to remain therein. Carswell, Johnston, Adel, Taylor and Lewis, JJ., concur.
