MOTION DECISION

PRESENT: Hon. Cynthia S. Kern, Angela M. Mazzarelli Ellen Gesmer Jeffrey K. Oing Peter H. Moulton, Justice.

Defendant, by Mental Hygiene Legal Service, having moved for an order granting permission to Sherman H., pursuant to CPL § 330.20 (21) (a) (ii), to appeal to this Court from an order, Supreme Court, New York County (Kiesel, J.), entered on or about February 10, 2022, and from the order of commitment, same court, entered on or about February 15, 2022 which, under CPL § 330.20 (6), determined that Sherman H. suffers from a dangerous mental disorder as defined under CPL § 330.20 (1) (c), designated him a Track 1 acquittee, and committed him to the custody of the Commissioner of the Office of Mental Health for confinement in a secure psychiatric facility, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted.
