ORDER

On order of the Court, the application for leave to appeal the June 17, 2021 order of the Court of Appeals is considered. We DIRECT the Roscommon County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order. The prosecutor shall specifically address whether the defendant "was serving" or "had become liable to serve" a sentence given that he had not yet been convicted of any crimes when he committed the offense in jail. See MCL 768.7a(1).

The application for leave to appeal remains pending.
