People of Michigan v. Crystal L Shelton-Randolph

LC No. 14-035996-FC

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The application for leave to appeal is DISMISSED for lack of jurisdiction. A second application for leave to appeal cannot be filed from the judgment of sentence dated September 12, 2016, and entered in the circuit court register of actions on September 13, 2016, where a prior appeal from that judgment of sentence was taken by leave granted in Court of Appeals Docket Number 335044. MCR 7.205(A)(5). Further, it appears that no new judgment or order that could be the subject of an application for leave to appeal was entered after the trial court's oral decision at the December 14, 2018 hearing in this matter. See MCR 7.203(B)(1)-(2) (providing this Court may grant leave to appeal from a circuit court judgment or order). Notably, defendant could seek to have the trial court enter an order reflecting its decision at the December 14, 2018 hearing and, if such an order is entered by the trial court, defendant could then file an application for leave to appeal from such an order within the six-month period allowed by MCR 7.205(A).

The motion for leave to supplement application for leave to appeal is DENIED as moot.
