Opinion

No. 123648.

December 29, 2003.

Summary Disposition.

No. 123648. In lieu of granting leave to appeal, the February 26, 2003, order of the Court of Appeals is vacated, and the case is remanded to that Court for plenary consideration as on rehearing granted. MCR 7.302(G)(1). The Supreme Court disapproves of the trial court's having dictated an additional rationale for its ruling without even notifying the parties that a supplemental ruling had been rendered. The lack of notice to the parties and the absence of any reference to this supplemental ruling in the trial court's docket entries resulted in an essentially useless appellate decision that was predicated on an incomplete lower court record. Notwithstanding, the Court believes administrative efficiency is served by having the Court of Appeals evaluate that ruling now. Court of Appeals No. 245877.
