On order of the Court, the motion for immediate consideration is DENIED. The motion to file original Court of Appeals application is GRANTED to the extent that the additional arguments received by this Court from the defendant on December 19, 2014 will be considered as part of his application for leave to appeal the September 19, 2014 order of the Court of Appeals. That application is considered, and it is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D).
