THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. SARAH A. MURPHY SEARS, DEFENDANT-APPELLANT.


PRESENT: , SMITH, CENTRA, PERADOTTO, AND CARNI, JJ.

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Steuben County Court, rendered April 29, 2014,

Now, upon reading and filing the affidavit of Sarah A. Murphy Sears sworn to January 29, 2015, the notice of motion with proof of service thereof, the statement of Philip J. Roche, Esq. dated February 10, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the pro se notice of appeal dated January 29, 2015, which was served upon the Steuben County District Attorney's Office on January 29, 2015, is hereby deemed timely served, and

It is further ORDERED that Sarah A. Murphy Sears is hereby directed to file the pro se notice of appeal dated January 29, 2015 at the Steuben County Clerk's Office in accordance with CPL 460.10 on or before April 3, 2015.
