2004-01194.

March 21, 2006.

Appeal by the defendant from a judgment of the Supreme Court, Queens County (Donnino, J.), rendered February 4, 2004, convicting the defendant of criminal possession of a weapon in the second degree, upon his plea of guilty, and imposing sentence.

Lynn W.L. Fahey, New York, N.Y. (Erica Horwitz of counsel), for appellant, and appellant pro se.

Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano and Nicoletta J. Caferri of counsel; Kristen Berg on the brief), for respondent.

Before: Florio, J.P., Krausman, Goldstein and Lifson, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).

The defendant has not raised any nonfrivolous issues in his supplemental pro se brief.
