People v. Scruggs

Appellate Division of the Supreme Court of New York, Fourth Department
Jan 20, 1978
60 A.D.2d 1003 (N.Y. App. Div. 1978)

Opinion

January 20, 1978

Present — Moule, J.P., Simons, Dillon, Hancock, Jr., and Denman, JJ.

Motion for change of venue denied. Memorandum: On this application it does not appear that a fair trial cannot be obtained in Chautauqua County, and at this time we deem the motion premature (see People v Di Piazza, 24 N.Y.2d 342; People v Hatch, 46 A.D.2d 721; People v Sekou, 45 A.D.2d 982).
