DECISION AND ORDER ON MOTION
Motion, pursuant to CPL 460.15, for permission to appeal to this Court from order of Supreme Court, Albany County, dated May 22, 2017, or, in the alternative, for writ of error coram nobis to vacate decision and order of this Court in People v Scott (129 AD3d 1306 [2015], lvs denied 26 NY3d 1089, 1092 [2015]).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
