People v. Schultz

Appellate Division of the Supreme Court of New York, Second Department
Mar 19, 1962
15 A.D.2d 948 (N.Y. App. Div. 1962)

Opinion

March 19, 1962

In a coram nobis proceeding, defendant appeals from an order of the County Court, Kings County, dated March 14, 1960, which denied, after a hearing, his application to vacate a judgment of said court, rendered November 21, 1952, after a jury trial, convicting him of burglary in the second degree, and sentencing him, as a fourth and subsequent felony offender, to serve a term of 15 years to life. On this application defendant challenged only the validity of the sentence, claiming that he should have been sentenced as other than a fourth and subsequent felony offender and requesting that he be resentenced accordingly. Order affirmed. No opinion. Beldock, P.J., Kleinfeld, Brennan, Rabin and Hopkins, JJ., concur.
