Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from the judgments of the Niagara County Court, rendered February 17, 2016,

Now, upon reading and filing the affidavits of Lester Scarbrough sworn to December 11, 2016 and January 1, 2017, the statement of Lester Scarbrough dated December 29, 2016, the notice of motion with proof of service thereof, the affirmation of Joseph J. Terranova, Esq. dated December 28, 2016, the statement of Thomas H. Brandt, Esq. dated December 21, 2016, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and Joseph J. Terranova, Esq. is hereby directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before April 5, 2017.
