Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Ontario County Court, rendered January 4, 2013,

Now, upon reading and filing the affidavit of Michael A. Sapp sworn to September 18, 2013, the notice of motion with proof of service thereof, the statement of R. Michael Tantillo, Esq. dated September 30, 2013, and the statement of Leanne Lapp, Esq. dated October 1, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and Michael A. Sapp is hereby directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before November 14, 2013.
