Submitted September 26, 2001.

January 22, 2002.

Appeal by the defendant from a judgment of the County Court, Putnam County (Miller, J.), rendered November 15, 2000, convicting him of criminal possession of a controlled substance in the fifth degree, upon his plea of guilty, and imposing sentence.

Neal D. Futerfas, White Plains, N.Y., for appellant.

Kevin L. Wright, District Attorney, Carmel, N.Y. (Mary Jane MacCrae of counsel), for respondent.

Before: DAVID S. RITTER, ACTING P.J., SANDRA J. FEUERSTEIN, WILLIAM D. FRIEDMANN, GLORIA GOLDSTEIN, STEPHEN G. CRANE, JJ.

ORDERED that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see, Anders v. California, 386 U.S. 738; People v. Paige, 54 A.D.2d 631; cf., People v. Gonzalez, 47 N.Y.2d 606).

RITTER, ACTING P.J., FEUERSTEIN, FRIEDMANN, GOLDSTEIN and CRANE, JJ., concur.
