People v. Santos

Appellate Division of the Supreme Court of New York, First Department
Dec 2, 2008
57 A.D.3d 215 (N.Y. App. Div. 2008)

Opinion

Nos. 4697, 4698.

December 2, 2008.

Judgment, Supreme Court, New York County (Richard D. Carruthers, J.), entered July 17, 2006, convicting defendant, after a jury trial, of insurance fraud in the third degree and falsifying business records in the first degree, and sentencing her to a term of five years' probation and a $5,000 fine, unanimously affirmed.

Steven Banks, The Legal Aid Society, New York (Steven Berko of counsel), for appellant.

Robert M. Morgenthau, District Attorney, New York (Lucy Jane Lang of counsel), for respondent.

Before: Mazzarelli, J.P., Saxe, Catterson, Renwick and Freedman, JJ.

The jury's verdict was not against the weight of the evidence ( see People v Danielson, 9 NY3d 342, 348-349). Defendant's guilt was established by the testimony of multiple witnesses, and we find no basis for disturbing the jury's decision to credit those witnesses.
