PRESENT:

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from the judgment of the Supreme Court, Monroe County, rendered May 23, 2016,

Now, upon reading and filing the affidavit of Desmond K. Sanders sworn to January 31, 2017, the notice of motion with proof of service thereof, the statement of Daniel Gross, Esq. dated February 17, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the pro se notice of appeal filed at the Monroe County Clerk's Office on September 19, 2016 and served upon the Monroe County District Attorney on September 16, 2016 is hereby deemed timely filed and served.
