On order of the Court, the application for leave to appeal the April 2, 2014 order of the Court of Appeals is considered and, pursuant to MCR 7.302(H)(1), in lieu of granting leave to appeal, we DIRECT the Calhoun Circuit Court to order preparation of a transcript of the October 18, 2013 evidentiary hearing, if not already done, and to forward a copy of the transcript to the parties and to this Court within 42 days of the date of this order.
We further DIRECT the Calhoun County Prosecuting Attorney to answer the application for leave to appeal within 21 days after the date of receipt of a copy of the transcript. In particular, the prosecuting attorney shall address its role, if any, in the evidentiary hearing held on October 18, 2013, and whether the defendant was represented by appointed counsel. See MCR 6.505(A).
The application for leave to appeal remains pending.
