ORDER MODIFYING OPINION AND DENYING REHEARING [NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on June 28, 2011, be modified as follows:

1. On page 10, the first full paragraph, beginning “When the second and third groups were seated, ” is deleted and the following is inserted in its place:

After challenges were made and new groups of jurors were seated, they were asked if anyone would have difficulty considering the testimony of law enforcement and if anyone would be disappointed if the case turned out to be unlike a television show. Each attorney was also permitted to ask follow-up questions of the entire panel.

2. On page 12, the first full sentence following footnote 6, beginning “Although the trial judge” and ending “of prior questioning”, is deleted and the following is inserted in its place:

Although the trial judge did not propound identical questions to each newly seated potential juror or group of jurors, all of the prospective jurors were present in the courtroom during the voir dire and heard the full spectrum of prior questioning.

There is no change in the judgment.

With the above modifications, the petition for rehearing is denied.
