THE COURT:

It is ordered that the opinion filed herein on October 2, 2003, be modified as follows: Delete footnote 3 at page 3. Except for deletion of footnote 3, the opinion previously filed remains unchanged. This modification does not effect a change in the judgment.

The petition for rehearing is DENIED.
