May 16, 2006
29 A.D.3d 829 (N.Y. App. Div. 2006)

Opinion

2004-02575.

May 16, 2006.

Appeal by the defendant from a judgment of the County Court, Westchester County (Zambelli, J.), rendered March 9, 2004, convicting him of manslaughter in the first degree, upon his plea of guilty, and imposing sentence.

Scott B. Tulman, New York, N.Y., for appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Michael Jeffrey Ashraf and Richard Longworth Hecht of counsel), for respondent.

Before: Goldstein, J.P., Mastro, Rivera and Lunn, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Stokes, 95 NY2d 633; People v. Vasquez, 70 NY2d 1; cf. People v. Gonzalez, 47 NY2d 606).
