Opinion

January 29, 1979

Appeal by defendant from a judgment of the Supreme Court, Richmond County, rendered September 10, 1975, convicting him of robbery in the first degree (two counts), upon a jury verdict, and imposing sentence. Judgment affirmed. We have previously affirmed the judgment of conviction of appellant's codefendant (People v. Miller, 54 A.D.2d 1140). There is no basis for a distinction in this case. Damiani, J.P., Titone, Shapiro and Margett, JJ., concur.
