MOTION DECISION

Present - Hon. Dianne T. Renwick, Acting Presiding Justice, Jeffrey K. Oing Tanya R. Kennedy Martin Shulman Bahaati E. Pitt-Burke, Justices.

An appeal having been taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about June 03, 2019, And defendant-appellant having moved for summary reversal of the aforesaid judgment, or in the alternative, for an order extending the time in which to perfect the appeal and remitting the matter to the trial court for a reconstruction hearing, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of directing defendant-appellant to, within 10 days of the date hereof, serve a copy of this order upon the principal or supervising court reporter for New York Supreme Court, Criminal Term, together with the list of transcripts asserted to be outstanding in paragraph two of counsel's affirmation in support of the instant motion, which shall be deemed good and sufficient service upon the court reporter(s), who are directed to furnish defendant-appellant's counsel with said transcripts, without charge, within 30 days of the date hereof. The time in which defendant-appellant is to perfect the aforesaid appeal is extended to the October 2023 Term of this Court.
