Appellant having moved to consolidate the appeal taken from a judgment of the Onondaga County Court, rendered August 10, 2009 (KA 10-00469), with an application pursuant to CPL 460.15 seeking permission to appeal from an order of Onondaga County Court, dated December 27, 2013 (KA 14-00186),

Now, upon reading and filing the affidavit of Maurice Russell, sworn to January 13, 2013 [sic], the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as premature.
