Defendant having moved pursuant to CPL 460.10(6) to extend the time to serve a notice of appeal from a judgment of the Orleans County Court, rendered October 17, 2011,

Now, upon reading and filing the affidavit of Cheyenne J. Russaw, Jr. sworn to May 31, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal served upon the Orleans County District Attorney on November 18, 2011 is hereby deemed timely served.
