DECISION & ORDER ON MOTION

Motion by appellant to stay all proceedings pending the determination of the appeal on an appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered July 15, 2021.

Upon the papers filed in support of the motion and the papers having been filed in opposition thereto, it is

ORDERED that the motion is granted on condition that appellant perfects the appeal on or before February 17, 2022; and it is further

ORDERED that in the event that the appellant does not perfect the appeal by February 17, 2022, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may serve such application upon the appellant in person.
