Summary
In People v. Rubero, 294 A.D.2d (1st Dept 2002), lv denied, 98 N.Y.2d 713 it was proper to sentence the defendant to consecutive sentences for the robbery and attempted murder of a store owner where the evidence established that the defendant initially took the victim's property and only thereafter formed the new intent to commit the attempted murder of the same person evinced by his conduct in shooting the victim in the face.
