By order of March 12, 2002, this Court directed the prosecutor to answer the delayed application for leave to appeal from the June 8, 2001 decision of the Court of Appeals. The prosecutor having responded, the delayed application is considered again, and pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted, limited to the issue of whether MCR 6.302(D)(2) was fulfilled. In all other respects, leave to appeal is DENIED.
