Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Wyoming County Court, rendered January 11, 2011,

Now, upon reading and filing the affidavit of Norman P. Effman, Esq. sworn to January 30, 2012, the notice of motion with proof of service thereof, the statement of Donald G. O'Geen, Esq. dated February 2, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal filed at the Wyoming County Clerk's Office on February 18, 2011, and the notice of appeal served upon the Wyoming County District Attorney's Office on February 10, 2011 is hereby deemed timely filed and served.
