Appellate Division of the Supreme Court of New York, Second Department
Jun 12, 2000
273 A.D.2d 327 (N.Y. App. Div. 2000)

Opinion

Submitted April 19, 2000.

June 12, 2000.

Appeal by the defendant from an amended judgment of the County Court, Westchester County (Zambelli, J.), rendered December 15, 1998, revoking a sentence of probation previously imposed by the same court (Murphy, J.), upon a finding that he had violated a condition thereof, upon his admission, and imposing a sentence of imprisonment upon his previous conviction of criminal possession of a controlled substance in the fourth degree.

Barry E. Warhit, White Plains, N.Y., for appellant.

Jeanine Pirro, District Attorney, White Plains, N.Y. (Richard Anthony Portale and Bruce Edward Kelly of counsel), for respondent.

Before: CORNELIUS J. O'BRIEN, J.P., MYRIAM J. ALTMAN, WILLIAM D. FRIEDMANN, LEO F. McGINITY, NANCY E. SMITH, JJ.

DECISION ORDER

ORDERED that the amended judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see, Anders v. California, 386 U.S. 738; People v. Paige, 54 A.D.2d 631; cf., People v. Gonzalez, 47 N.Y.2d 606).
