It is ORDERED that the opinion filed herein on November 29, 2011, be modified as follows:

1. On page 2, third sentence of the first full paragraph, the word "premedication" is changed to "premeditation" so the sentence reads:

"We agree there was no evidence of deliberation and premeditation."
This modification does not change the judgment.
