People v. Rosado

Appellate Division of the Supreme Court of New York, First Department
Jun 16, 1998
251 A.D.2d 173 (N.Y. App. Div. 1998)

Opinion

June 16, 1998

Appeal from the Supreme Court, Bronx County (Steven Lloyd Barrett, J.).

Defendant's suppression motion was properly denied. We see no reason to disturb the courts determinations crediting the testimony of the arresting officer ( see, People v. Prochilo, 41 N.Y.2d 759, 761). We perceive no abuse of sentencing discretion.

Concur — Milonas, J. P., Nardelli, Wallach and Saxe, JJ.
