The People of the State of New York, Respondent, v. Eric Rosa, Defendant-Appellant.
Defendant having moved for an order deeming the notice of motion a timely filed notice of appeal, or in the alternative, granting permission to file an untimely notice of appeal, from a judgment of the Supreme Court, New York County, rendered on or about December 12, 2019, and for poor person relief and the assignment of counsel, Now, upon reading and filing the papers with respect to the motion, and the letter from The Legal Aid Society (Michelle Fox, of counsel) withdrawing the motion, and due deliberation having been had thereon, It is ordered that the motion is withdrawn pursuant to the aforesaid correspondence.
