THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. FELIPE A. ROMERO, ALSO KNOWN AS JOHN DOE, DEFENDANT-APPELLANT.


PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

Appellant having moved for an extension of time to file and serve a pro se supplemental brief on the appeal taken from a judgment of Supreme Court, Monroe County rendered February 2, 2010, and respondent having cross-moved for permission to file and serve ten copies of a combined brief in response to a brief filed by appellate counsel and a pro se supplemental brief,

Now upon reading and filing the affidavit of Felipe A. Romero sworn to January 31, 2014, the notice of motion with proof of service thereof, the affirmation of Hannah Stith Long, Esq. dated February 27, 2014, the notice of cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that appellant shall file 10 copies of a pro se supplemental brief, with proof of service of one copy on assigned counsel and the People pursuant to 22 NYCRR 1000.3 (f), on or before April 16, 2014, and

It is further ORDERED that the cross motion is granted, and respondent shall file a combined brief, if any, on or before May 1, 2014, and

It is further ORDERED that appellate counsel shall file a reply brief, if any, on or before May 16, 2014, and

It is further ORDERED that appellant shall file a pro se reply brief, if any, on or before May 16, 2014.
