Jun 26, 1975
337 N.E.2d 130 (N.Y. 1975)

Opinion

Argued June 11, 1975

Decided June 26, 1975

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department, THEODORE A. KELLY, J.

Irving Anolik for appellants.

Robert R. Meehan, District Attorney (Thomas E. Urell of counsel), for respondent.

Order affirmed. The record shows a sufficient pattern of conduct by the defendants, as to one over a period of time and as to the other on the day in question, to justify the finding of probable cause (cf. People v Brown, 24 N.Y.2d 421, 423-424).

Concur: Chief Judge BREITEL and Judges JASEN, GABRIELLI, JONES, WACHTLER, FUCHSBERG and COOKE.
